To the maximum extent permitted by law, Polar Night shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee that our services will prevent all chargebacks or that our analytics will be error-free. You use our services at your own risk.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the services will immediately cease. We may retain your data as required by law or for legitimate business purposes.

We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through the services. Your continued use after such notice constitutes acceptance of the updated terms.

12. Governing Law

These terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
